Lyon Leisure Limited: Flusco Wood & Hartsop Fold Booking Terms & Conditions
1 Introduction
We are Lyon Leisure Limited (“we”, “our”, “us”) of Old Quarry Lodge, Flusco, Penrith, Cumbria, CA11 0JB. We operate as Flusco Wood and Hartsop Fold. By booking with us, you confirm that you accept these booking conditions and any other written information we bring to your attention before confirming your booking.
2 Care
The main condition of acceptance of any booking is that good care is taken of any of the properties and contents and that the place is left truly clean and tidy, as you will find it. This care to include all utensils, crockery, etc.
3 Holidays
To give us as much time as possible to prepare your lodge, holidays start from 4.00 p.m. on the day of arrival until 10.00 a.m. on the day of departure.
4 Lodge Allocation
In the interest of site management, the proprietors reserve the ultimate right to allocate lodges.
5 Deposit
A deposit of 50% of the rental is payable to confirm your booking, up to a minimum of £75 total. The minimum of £75 is non-refundable. The balance of rental is payable 6 weeks before the holiday.
6 Last Minute Bookings
Where bookings are made less than 6 weeks before arrival, the full amount of rental is payable when booking.
7 Quoted prices & VAT
All quoted prices for holidays are honoured for 24 hours from the time you are given them. After this they may be subject to change. VAT is included in all quoted prices.
8 Security Deposit
A security deposit may be taken on arrival
9 Your use of the booking
Your booking and the accommodation is made available to you for your personal, non-commercial use only. You may not offer for resale any booking made through us without our express written permission.
10 Occupancy
Each property is offered for rent only on the understanding that no more than the maximum number of people as indicated in the brochure shall use it, except by prior agreement. We cannot be liable for any loss, damage, sickness or injury howsoever caused which may be sustained during the holiday to the Tenant and any member of the party, or any invited person. Prices quoted are for 4 berth lodges.
11 Dogs
A maximum of 2 dogs are allowed in certain lodges. An extra charge of £35 per dog per week or part week will be made. Dogs must not be left unattended in the lodge at any time.
Administration fees
If you must make amendments to your booking it may be subject to an administration fee for our services. These fees are listed below, and the cost is based on the number of days prior to the start of the holiday:
- Each change of date (more than 14 days): £25
- Each change of lodge (within the same type booked): £25
- Each change of date (less than 14 days): £50
- Each change of accommodation (more than 14 days): £75
- Each change of accommodation (less than 14 days): £100
- Cancellation: £75
13 Cancellation
If you must cancel your booking, your party leader must telephone us. The day we receive your telephone notification of cancellation is the date the booking is cancelled.
Policy on Refunds. After deducting the cancellation fee of £75 per lodge, a refund will be paid based on the number of days’ notice given prior to the start of the holiday as shown in the following list:
- More than 70 days: Full refund less non-refundable deposit and administration fee
- 29 to 70 days: 50% refund less administration fee
- 15 to 28 days: 25% refund less administration fee
- 14 days or less: 10% refund less administration fee
- On arrival date or later: No refund.
14 Cancellation Insurance
We recommend that you take out travel insurance to cover you in the event of cancellation.
Cancellation by us
If in the unlikely event that your accommodation becomes unavailable for whatever reason, then we will inform you of this as soon as possible and endeavour to find alternative accommodation for you. No guarantee can be given of this. If you choose to cancel, all monies will be refunded to you.
15 Arrival and Departure
You may arrive at your accommodation any time after 4pm on the first day of your booking and you must leave by 10am on the last day (unless we tell you otherwise). If you do not arrive by 12pm on the second day of your booking and haven’t informed us of your late arrival we may consider you booking cancelled by you, with no refund payable.
Behaviour
We can deny access to the accommodation or end your stay if anyone in your party behaves unreasonably, causes offense or damage, disrupts others, or violates booking conditions or restrictions on the accommodation advertisement. If we believe this likely or such behaviour occurs, the contact will end, you must leave immediately, no refund will be given, and you may be responsible for any costs incurred due to your behaviour. We will have no further responsibility to you. You and your party agree:
- To keep the accommodation clean and tidy, and leave it in the same condition as you found it. If additional cleaning and/or repairs are required, you will be responsible for the cost;
- not to use the accommodation for any illegal or commercial purpose;
- not to sublet the accommodation or any part of it or otherwise allow anyone not in your party to stay;
- not to behave in an anti-social manner or act in a way which may disrupt or of affect the enjoyment of others;
- to comply with any restrictions or requirements specified in the accommodation advertisement, such as regarding party composition; and
- that failure to comply with the above will result in your booking being cancelled and we will not have any legal or financial responsibility to you.
17 Electricity, gas, and water
Electric, gas, and water consumption is included in the lodge rental. Consumption is based on previous customer experience and we reserve the right to surcharge for excessive consumption.
18 Equipment
Each Lodge is equipped with sufficient crockery, cutlery, kitchen equipment, dining and easy chairs, beds and bedding for the maximum number of people as indicated.
19 Cots and Highchairs
Cots can be hired, in advance at no extra cost.
20 Parking
If you plan to bring more than one car, please advise us. No caravans.
21 Vehicles and belongings
Luggage is at owner’s risk at all times, as is any car and its contents.
22 Smoking
Smoking is strictly prohibited inside any building or accommodation at Flusco Wood or Hartsop Fold. Failure to comply may result in you being asked to leave the park.
23 EV Charging
Charging of electric vehicles from the lodge or accommodation is not permitted and may result in you being asked to leave the park.
24 Drones
The flying of drones is not permitted at either Flusco Wood or Hartsop Fold without our express written permission.
25 Fireworks
No fireworks or Chinese lanterns are allowed on site.
26 Camp fires
No camp fires allowed at any time.
27 Damage
You are responsible for the actions and omissions or all guests staying at the accommodation during the booking and agree to pay the Owner for all costs incurred by the Owner and/or as a result of any breakage or damage in or to the accommodation caused by you, your party or anyone your invite round. If you discover that anything is missing or damaged on arrival, please notify us immediately. Any damage must be reported to us immediately, otherwise we are unable to investigate the matter fully. It is too late to report the matter after the holiday.
28 Complaints
If there should be any incidents or cause for complaint you must:
- report it to us immediately;
- allow us a chance to react/put right any issues before your departure;
- communicate with us directly about any follow up.
29 Liability
We, our agents or servants cannot accept liability for any personal injury or death, damage or loss which may be sustained by the applicant or their property during the period of their stay at Flusco Wood or Hartsop Fold, except through negligence of the site, its agents, or servants.
30 Limitation
We cannot be held responsible for
- Noise or disturbance which comes from beyond the boundaries of the accommodation, or which is beyond our control.
- The failure of public utilities such as water and electricity.
- Changes or closures to local services or attractions mentioned on our website and other information.
Even if everything goes wrong and you do not receive any benefit from the stay, and we are found to be wholly or partly responsible to you, we limit the maximum we will be liable to pay you is the rental cost of the accommodation you have paid i.e. a full refund.
31 Events beyond our control
Unless otherwise stated in these booking terms and conditions, we are not responsible, nor will we compensate you, for events beyond our control which could not be avoided, despite reasonable measures. Examples are warfare, terrorism, civil strife, significant health risks (e.g. epidemics, pandemics), weather, natural disasters, government or authority actions, industrial disputes/strikes, failure or utility services, lock closures, fires, leaks, unavoidable transport issues and similar events.
